1- Definition of the principle of the authority of will:
The principle of the authority of will or what is also called (the basis of the binding force of the contract) means the freedom of will and its sufficiency in creating contracts and legal actions and in determining their effects, as the will is the basis of the contract's ability to create the obligation and the basis of its binding force for its contracting parties.
2- Definition of the principle of the authority of will: The principle of the authority of will includes two basic rules:
A- The rule of consent: It means that the will alone is sufficient to create the contract and the legal action in general without the need to be emptied in a specific form.
B- Freedom of will in determining the effects of the contract: The joint will of the contracting parties is free to determine the effects resulting from the contract (obligations), so that these obligations only exist to the extent and within the limits drawn by the contracting parties, and in other words, the terms of the contract are only the creation of the contracting parties without interference from any party, and this is what the Algerian legislator expressed in the text of Article 106 of the Civil Code, which states: "The contract is the law of the contracting parties and may not be revoked or modified except by agreement of the two parties, or for reasons determined by the law."

The origin and development of the principle of the authority of the will
The ancient laws, such as Roman law, did not know the principle of the authority of the will, especially with regard to the sufficiency of the will to create a legal act without the necessity of it coming in a certain form, as the prevailing rule in Roman law remained formal, while consent is the exception, so that according to the origin, the agreement of the two wills is not enough for the contract to be established, but rather certain formal procedures must be taken (exchanging certain phrases or writing a certain formula or delivering something).
In the Middle Ages, the principle of the authority of the church prevailed and the principles advocated by canon law had a great impact on the spread of the principle of the authority of the will, as the church called for respect for covenants and agreements and considered breaching them at first a religious sin and then a breach of a legal obligation. Thus, canon law is the cradle of the principle of the authority of the will, as it considers that every agreement is binding even if it is devoid of form, so the origin here was the consent of contracts. The development of the principle of the authority of the will increased in the eighteenth and nineteenth centuries due to several factors, the most important of which is the spread of the individual doctrine that sanctifies individual freedom and makes the law a single goal, which is to guarantee this freedom, so the idea of the independence of the will prevailed as the basis for all systems Legal, economic and social) from that the rule of let him do, let him pass Adam Smith, and from its applications in this field let him contract as he pleases, and French law came saturated with these ideas.
After this prosperity that the principle of the authority of the will knew, the principle began to shrink during the 20th century under the influence of socialist principles and economic and political changes, in contrast to the individualist doctrine, the socialist doctrine calls for the predominance of the interest of society over the interest of the individual, and accordingly the will does not have the ability and authority to create the contract and determine its effects except within the limits and according to the conditions determined by society (the law). The will has no authority above the authority of the law that speaks for the interest of the group. This situation resulted in the decline of the principle of the authority of the will through the emergence of contracts in which the will and individual freedom are not taken into account, such as the employment contract, the company contract and contracts of adhesion .... etc.
